Terms and Conditions "Marly’s Monthly Giveaway"
The organizer of the competition is Hey Marly GmbH, Vogelsanger Straße 80a, 50823 Cologne, Germany (hereinafter "Hey Marly"). For questions about the competition: service@heymarly.com.
By participating in the competition, the participant accepts these terms and conditions.
The competition is in no way associated with Facebook and Instagram and is neither sponsored nor supported or organized by Facebook and Instagram. Facebook and Instagram are not available as contact persons for the competition.
1. Procedure and participation period
• The competition takes place monthly in separate rounds. Each round begins with the dispatch of the corresponding newsletter, which contains a link to participate.
• The participation period for a round is seven (7) days from the dispatch of this newsletter. After the participation period has expired, it is no longer possible to participate in the respective round.
• Participation takes place by the participant registering for the participant list of the current round via the link included in the newsletter.
• After the participation period has expired, a winner will be drawn at random from all valid entries in the respective round. Notification will be sent by e-mail to the address provided during participation.
• After the draw, the participant list will be reset. Participation in one round does not automatically lead to participation in subsequent rounds; re-registration is required for each round.
2. Eligibility
• Participation is free of charge and not tied to a product purchase.
• Eligible to participate are natural persons who are at least 18 years old and have full legal capacity under the laws of their country of residence and have a valid postal address.
• Participation is possible regardless of the country of residence. However, prizes will only be shipped to countries to which Hey Marly regularly delivers. If delivery to the country of the drawn person is not possible, the claim to the prize expires and a new winner will be drawn.
• Participation requires an active subscription to the Hey Marly Newsletter. Consent to receive the newsletter is given via a double opt-in procedure.
• Consent to receive the newsletter can be revoked at any time with future effect, for example via the unsubscribe link in each newsletter. Revocation is free of charge and does not lead to any disadvantages – with the exception that participation in future rounds of the competition will then no longer be possible. An already made entry into the current round remains valid until the draw of this round.
• Only subscribers who have opened at least one newsletter or clicked on a link in it within 30 days before the start of the respective round are eligible to participate. This is based on the statistical evaluation of the newsletter dispatch, which was consented to with the newsletter registration. Further details can be found in our privacy policy.
• Only one participation per e-mail address is possible per round.
• Participation with fake identities or third-party identities is not permitted.
• Participation through lottery clubs, participation or registration services, as well as automated participation, are excluded.
• Employees of Hey Marly GmbH and their relatives living in the same household are excluded from participation.
3. Prize and prize handling
• One item from the Hey Marly range, selected by Hey Marly, will be raffled off per round. The prize value corresponds to the regular, non-reduced retail price of the item displayed in the online shop at the time of the draw.
• The prize will be shipped at Hey Marly's expense to the delivery countries mentioned in section 2.
• For shipments to countries outside the European Union, customs duties, import VAT or other charges may apply. These, as well as any taxation of the prize according to the law of the country of residence, shall be borne by the winning person.
• If the item drawn is not available at the time of prize processing, Hey Marly reserves the right to provide an equivalent item as a substitute prize.
• The prize is not transferable, cannot be exchanged, and cannot be paid out in cash.
• If the drawn person does not respond within five (5) working days after receipt of the prize notification, the claim to the prize expires. In this case, Hey Marly is entitled to draw a new winner.
• If the prize cannot be delivered due to incorrect or incomplete information provided by the participant, the claim to the prize expires.
• The winner will only be named or displayed on Hey Marly's channels with prior, separate and revocable consent.
4. Data Protection
• Hey Marly GmbH, Vogelsanger Straße 80a, 50823 Cologne, Germany, is responsible for the processing of personal data collected in connection with the competition. Data protection inquiries: service@heymarly.com.
• The data collected during participation (in particular e-mail address and, in the event of a win, name and delivery address) will be processed exclusively for the purpose of carrying out the competition and processing the prize. The legal basis is Art. 6 para. 1 lit. b GDPR.
• Data will only be passed on to the service providers commissioned with the dispatch of the prize and to the newsletter service provider, in each case to the extent necessary.
• The participation data will be deleted after the end of the respective round and the processing of the prize, unless there are statutory retention obligations to the contrary. The processing of the data for newsletter dispatch is governed by the granted newsletter consent and remains unaffected by this.
• If data is transferred for prize processing to a country outside the European Union, this is done in accordance with Art. 49 para. 1 lit. b GDPR, as the transfer is necessary for the delivery of the prize.

5. Exclusion from participation
• Hey Marly is entitled to exclude individuals from participation and the draw if there is a valid reason, particularly in the event of a violation of these terms and conditions, manipulation, or attempts at manipulation.
• If a reason for exclusion only becomes apparent after the prize has been handed over, Hey Marly can reclaim the prize retrospectively.
6. Premature termination and changes
• Hey Marly reserves the right to cancel or terminate the competition or an individual round if proper execution cannot be guaranteed due to technical reasons (e.g., manipulation, errors in hardware or software, malware) or legal reasons. A cancellation will only take place if it is reasonable for the already registered participants; they will be informed about this.
• Hey Marly reserves the right to change these terms and conditions. Changes apply exclusively to future rounds of the competition. For a round that has already begun, the terms and conditions published at the beginning of that round remain valid.
7. Liability
• Hey Marly is liable under statutory provisions for intent and gross negligence, for damages resulting from injury to life, body or health, upon assumption of a guarantee, and under the Product Liability Act.
• In the event of slight negligence in the breach of essential contractual obligations, liability shall be limited to typical, foreseeable damage; otherwise, liability shall be excluded, in particular for technical faults and delays in data transmission for which Hey Marly is not responsible.
8. Final Provisions
• The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of the state in which the participating person has their habitual residence remain unaffected.
• Should individual provisions of these terms and conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected.
